Terms and Conditions for SMS Text Messaging

Please read these terms and conditions carefully. By Opting-In to sign up for one or more text messaging
notifications, you expressly consent to receive text messages from Capital Area NCWorks Center system
(including NextGen Centers) (“Center”) and others texting on its behalf, including text messages made
with an autodialer, at the telephone number(s) that you provide. You may opt-out of these
communications at any time. Consenting to receive text messages is not required to receive Center
services.

You also accept and agree to be bound by these SMS Terms and Conditions and our Privacy Policy.

Program Description

Center and its service providers may use an automatic telephone dialing system (“autodialer”) to deliver
text messages to you. Center text messages are intended to provide you with information about upcoming
events, job opportunities, workshops and general information that may be of interest to you during your
job search. Text messages may also be used for appointment reminders, and other activities that you may
have registered for.

Message Frequency

The number of Center text messages that you receive will vary depending on how many of Center’s text
messaging programs for which you sign up to receive messages. You will receive a maximum of five (5)
messages per month for Center Activities/events, job notices, etc. per Center text messaging
program. However, you may receive additional messages regarding appointments, or one-on-one
correspondence with Center staff regarding your individual job search.

Cost

Message and data rates may apply to each text message sent or received in connection with Center text
messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone
carrier for pricing plans), in addition to any applicable roaming charges. Center does not impose a
separate fee for sending Center text messages.

Supported Carriers

Carriers are not liable for delayed or undelivered messages. Supported carriers may change from time to
time, but currently include AT&T, T-Mobile, Verizon Wireless, Sprint, Nextel, Boost, Alltel, US
Cellular, US Mobile, Cricket, Metro PCS, and Cellular One, among others.

Eligibility

Children under the age of 18 may not sign up for a texting account or use any texting services without the
written consent of a parent or guardian, which will be permitted for children 13-17 as necessary.

How to Opt-In

To opt-in to receive text messages from a Center text messaging program(s), please follow the
instructions provided by the specific information provided to you when registering for an event, making
an appointment, or any other Center tool where you are asked to opt-in to receiving SMS messages. The
Opt-In serves as your electronic permission for a Career Center staff to send you text messages. When
you Opt-In to receive text messages, this is your acknowledgment that the electronic signature and opt-in
has the same legal weight of a written signature. This electronic permission is kept/stored in the text
messaging platform used by Capital Area Workforce Development Board.

How to Opt-Out

To stop receiving text messages from a specific Center text messaging program, text STOP to the
number provided for the text messaging program from which you no longer wish to receive
message (i.e., the number from which its text messages are being sent). You will then receive
confirmation of your opt-out of that text messaging program. This will only opt you out of the specific
text messaging program associated with that number. You will remain opted in to other Center text
messaging programs as applicable.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You
are responsible for notifying Center immediately if you change your mobile telephone number. You may
notify Center of a number change at any time.

You agree to indemnify Center in full for all claims, expenses, and damages related to or caused in whole
or in part by your failure to notify Center if you change your telephone number, including, but not limited
to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Privacy Policy

Text message correspondence sent to and received from Capital Area Workforce Development may be
subject to disclosure under the North Carolina Public Records Act unless made confidential under
applicable law. We take measures to protect your sensitive personal information but cannot guarantee its
security in transit or storage. You should avoid transmitting confidential or sensitive information
including, but not limited to, Personal Identifiable Information (PII), Protected Health Information (PHI),
financial information, etc. via text message with us.

Access or Delivery to Mobile Network is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or
conditions. You understand and acknowledge that network services, including but not limited to mobile
network services, are outside of Center’s control, and Center is not responsible or liable for issues arising
from them.

Support/Help

To request more information, text HELP to the five digit short code for the text messaging program about
which you have questions (i.e., the five digit number from which its text messages are being sent). You

Changes to Terms and Conditions

Center may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision,
modification, or amendment shall take effect when it is posted to Center’s website. You agree to review
these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your
continued consent to receive Center text messages will indicate your acceptance of those changes.

Termination of Text Messaging

Center may suspend or terminate your receipt of Center text messages if Center believes you are in breach
of these SMS Terms and Conditions. Your receipt of Center text messages is also subject to termination
in the event that your mobile telephone service terminates or lapses. Center reserves the right to modify
or discontinue, temporarily or permanently, all or any part of Center text messages, with or without
notice.

Communications and Consent to Electronic Notice

You may communicate with Center via postal mail, telephone, and our website. Contact information and
Center locations are available at www.capitalareancworks.com. Center may issue notices via these
various channels, including by sending e-mail to an address you provide. You agree that such notices
shall have legal effect.

You also agree that notices sent by e-mail satisfy any requirement that notices be provided in writing. If
you do not agree, you may have the right to withdraw your consent to receive certain electronic
communications, and, when required by law, Center will provide you with paper copies upon
request. You may make such a request via any of the channels listed above.
